ana had some conversation with hia about the
Ships in Constanza. He tells me that some weeks
ago he wrote enquiring 2s to the intentions of
the operators of these two Ships, folicwing up
a couple of weeks ago with « letter consicerably
more severe in tone, and warning thet the regis-
tration of these vessels would unquestionably be
canceliec by his Gowernnent if they were used
fcr the purpose ef carrying illegal immigrants
to Pseiestine. To the last letter he has had no
reply. is cerrespondenece has not been with the
New Yoru Agents, of whom he professed to know
nothing, but with the Lawyers representing the
owners, Mecsrs. Foley & Statt, of 80 Broad Street,
his contact there being dr. Milton James. I know
cote aothing of this firm, but I an having enquiries:

tretion of the ships; it would then be toc late

like, ana there is clearly danger of the
New York attorneys entangling him in legalistic
delays for long enough for the ships to escape.
He professed to know nothing of the
"Colonel Frederick C. Johnson" in Norfolk, and
summoned the Vice Consul to ask whether he had
had any correspondence or information about this
ship, or its reputed owner. The Vice Consul
clearly knew nothing, and both he and the Consul
General assured me that while it was not certain
that application for Panamanian registry for the
Johnson would be made through the New York
Consulate General, it was more than likely, and
they undertook to let me know if any application
wes made.
The Consul General, Sr. Rogelio Fabrega,
has only comparatively recently arrived in New
York. While he was friendly and reasonably forth-
coming, I cannot say that he was enthusiastic in
his reception of me or in his response. I inagine
that he will require considerable stimulation from
Panama before taking positiwe action which, at the
best, is likely tc be no nore than 4 recommendation
to his Government, depending on the reply which he
receives from Foley & Statt for cancellation.
I am sending copies of this letter to
Chancery, Panama, and to North American Department.

Netherlands Embassy inform us that Kahn, whose temporary
address in New York is the seme as Dereoktors, hes come with a
letter of introduction from the Netherlands Assistant Direotor
General of Shipping te the Finaneial Counsellor of the
Netherlands Embassy here. This letter states thet Kahn is @
former Netherlands Consul General in Portugal and that he has
had verious discussions with the Assistant Direepor General of
Shipping about obtsining eredits froa United Stetes sources for
the purchase of eeean-going vessesl for Netherlands shipping
companies. The Netherlands Embassy is asked to give assis-
tance and advice to Kahn. ‘The Netherlanis Embassy say that
the question of the allecation of funds for the purchase of
Colenel F.C. Jehnsen is at present still under diseussien with

Dear Department,
In our telegrams Nos.6085 and 6451 (para 4)
we mentioned the warning which ir. Marshall has given
to certain Jewish leaders about illegal immigration
into Palestine.
Qe News of this has apparently leaked out.
A correspondent of "Newsweek" named Weintal, when
talking recently to a member of the Embassy staff,
spontaneously referred to what he described as the
sensational success of Mr. Bevin's message on the
subject. According to his information, the State
Department were determined to prevent the PAN YORK
and PAN CRESCENT from sailing. When he was asked how
the State Department proposed to achieve this, he
replied that Mr. Marshall had sent for Jewish leaders
(he mentioned Mr. Shertok) and had said that, unless
the sailings were prevented, he would publicise the
fact that the Jewish Agency was assisting the
immigration of Communists from Soviet-dominated states
into Palestine. Weintal was evidently trying to
verify this "hot" story and went on to say that one
of the disclosures threatened was to the effect that
a large sum of dollars had been paid to Amtorg in
New York for the refitting of ships at Constanza.
This point is new to us put it is of some interest
if true, in the light of the information contained
in our letter to you G124/-/47 of the 23rd October
reporting a conversation between Mr. Loy Henderson
and Mr. Shertok.

about the British attitude in India and the "murder

appears to me to be an open incitement to violence.

will not leave patesbine: by August 1948 unless they
are forced to. "Let's give them a push and make it
January instead of August", A little later it says

way the British snub the UN, the way they snub the whole

They are doing it again now when they refuse any coopera-
‘tion in a Palestinian settlement.
Like India, Like Palestine
The British could have avoided the horrible bloodshed in
India, but they delight in it. They go around saying “I told -
you so.”
We can prove that the British are deliberately planning a -
similar fate for Palestine. They are doing it ey They
are arming their. mercenary Arab puppets, and Bevin has
announced officially and brazenly that they will continue
to arm them.
They know that these arms are going to Palestine to be
turned against Hebrew men, women and children, but that
is precisely what they want, so that they may be able to
say, “I told you so”; so that they may prove the need for
their continued imperial occupation of Palestine.
We are against partition because the Hebrew people are
against it; because the fighting underground, whose heroism
and sacrifices brought Palestine to the UN, are against it.
We are against the Jewish Agency that gives away 85 per
cent of the Hebrew national territory, and collaborates
shamelessly with the British aggressors.
It was by order of the Jewish Agency that the British were
tipped off about an Underground house so tHat three teen-
age girls and two boys were murdered in cold blood by
“innocent” British soldiers.
It was not a clash with the Underground. It-was a massacre.
Of course the Underground retaliates and ten Englishmen
have paid with their lives, and blood again flows need-
lessly in Palestine.
No More Free Murder
Remember this, Emest Bevin and fellow anti-Semites;
Hebrew blood is no longer cheap. Sure, you can shed it;
but there is a price for it now and it is going’ to remain,
A high price. The extermination days are over. The killing
of Hebrews is being answered in kind.
Remember, anti-Semites of all sorts, wherever you are:
Hebrew blood is equal to any other blood. A Hebrew .
corpse is as sordid a sight as a British corpse. _
The world is learning that the Hebrews are no worse than
" ‘other human beings; they are also no better. They have the
right to be as good and as bad as the world’s other nations.
_ The Hebrews are not a sect, nor a clique, nor a strange
tribe. They are a nation, a normal nation, whose home is
Palestine. They live and fight like any other healthy nation.
As we Americans did (against the British); as the Irish did
(against the British); as the Boers did (against the British),
nae Just as the others won, the Hebrews too are going
o win, |
How soon they win and with how few sacrifices depends
entirely on the support they get from us—it depends on you.
The British say they will quit Palestine in August, 1948.
They will not do it’ unless they are forced to. Let’s make
sure they are. Let’s give them a push and make it Janua
instead of August, for only when the British leave wi
there be. peace in Palestine for all who dwell there—Jews,
Moslems, Christians alike. |
If the British do not leave, all the sacrifices will have been
in vain.
The Fight Put Palestine on the Map
It was the heroism and sacrifices of the Palestine Under-
ground that saved the honor of the Hebrew nation. It was
the tenacity of Hebrew soldiers that made Palestine an
important international problem. It is Hebrew fighting men
who will defend and finally liberate Palestine for all the
Hebrews who wait to go there, and not only for a chosen
few per month. | .
The fight needs your help. Don’t refuse it.
In a desire to help, American Jews this year have. con-
tributed $170,000,000 to “respectable” Jewish organiza-
tions, but that solved nothing; just as the $100,000,000 spent
in 1946 solved nothing. .
It was not the expenditure of these millions that put Pales-.
tine at the top of the UN agenda. It was the persevering
struggle for liberation conducted by the Hebrew Freedom
Movement in Palestine and abroad that forced the issue.
Only its continuation will assure final victory.

Five hundred Jewish illegal im-
migrants managed to slip through
the British brockade Saturday night
in a schooner disguised as a fishing
boat, but a group of 794 aboard a
second vessel were intercepted at]
sea and deported to Cyprus. -
_ The ‘refugees beached their craft
just north of the Jewish colony of
Nahariya, five miles south of the
Lebanese border. They waded
ashore at 2 a.m. and were helped.
to escape to Jewish settlements. in
- trucks. provided by the under-
ground army Haganah.
One of the refugees, a 17-year-
old Hungarian boy who was inter-
viewed by the United Press, said
most of the refugees came from
eastern Europe and the remainder
were French-speaking Jews. One
third were women, he said.
The youth said the 50-ton ship,
renamed the Aliya, left Lyons in
southern France on Nov. 6 flying
and these also sped off in different
directions to confuse pursuit if it
materialized.

The Hungarian youth said the
landing took 45 minutes. Ten extra
trucks were gathered at Nahariya
in addition to those for the refugees,

The successful landing apparent-
ly was made possible by a confu-
sion in signals between the Brit-
ish army and navy. Army and _po-
lice forces entered Nahariya and
attempted to set up a watch in the
high water tower there.
“Three British destroyers ap-
peared, off shore and the troops
left, apparently assured that the
havy. was on watch. Two of the
destroyers were called to intercept
the Kadima, however, and the Aliya
slipped through. | .
Partition Talk Stirs Hostile Feelings
At Arab-Jewish Rotary Club

but the war chill has crept over
the Jaffa-Tel Aviv Rotary Club.
They told me that this unique
club, where Arabs and Jews meet
on an equal footing as Rotarians,
would be the best place to dispel
the myth that the partition of
Palestine would mean war between
the Arabs and the Jewish commu-
ae Instead, I found there the
inability of Jews and Arabs to find
a basis for undérstanding in the
partition framework, even in a
fraternity such as Rotary. .
A. Jewish Engineer
And Arab Lawyer
By chance, I sat at the table
with the great planner of Tel Aviv,
Jacob Ben Sira, the city engineer
whose dream is coming true with
the growth of Tel Aviv from the
sand dunes 85 years ago to a Ri-
viera of 200,000-odd people today.
A friend of Ben Sira came to sit
with us, Habib Homsa, the most
prominent lawyer of Arab Jaffa,
which borders Tel Aviv. Homsa
is a Christian Arab, with deep
family ties to the Christian Arab
community of Lebanon.
' The Rotary speaker was dis-
cussing the cholera plague in
Egypt, but everyone there was
thinking of the partition debate at
Lake Success and Ben Sira men-
tioned partition.
‘Nothing to Do
But Fight It Out?
That mention brought sparks
flashing in Homsa’s eyes, and the
Arab lawyer launched into a dia-
tribe against both Britain and the
US A - |
“Tell your government,” he said
to me, “that in its generosity to the
| Jews it must stop being generous
- out of the pockets of the Palestine
Arabs and be generous out of its
own pocket.”
Then turning to Ben Sira, his old
friend and fellow Rotarian, Homsa
Said:
“When partition comes there js
nothing more to do but fight it
out, and we shall see who are the
best fighters.” -
Ben Sira, aghast at the outburst,
spoke of the possibility of: friend-
ship and collaboration between the
Jewish and Arab communities in-
side the partitioned states.
But that brought the bitterest
laugh from Homsa, who burst out
again with a diatribe against what
he. said was the stated Jewish
policy to refuse to employ Arab
labor on land in the Jewish settle-
ments. Ben Sira protested that such
prohibitions against the employ-
ment of any outside labor—Jewish
or otherwise—is a calculated move-
ment to put Jews back on the land
to live by the fruits of their own
labor.
‘But Homsa repeated merely:
“When partition comes we shall

no genuine and dangerous irrident-
ism in the Palestine Arab commu-
nity and that partition will not
cause conflict unless the Arabs are
stirred up by influences from out-
side. This Rotary luncheon would
seem to indicate otherwise.
U.S.A. to Insist on
UN Study of Veto

The U. S. A. appeared certain
today of winning its campaign in
the UN General Assembly for a
year-round study aimed at soften-
ing the Big Five veto power in the
UN Security Council.
U. S. Delegate John Foster
Dulles told Soviet Deputy Foreign
Minister Andrei Gromyko Satur-
day in a private conference that
the U. S. A. was going to press its
drive in spite of Russia’s vehement
opposition to any tampering with bl
the veto.
Would Leave Veto Only
In Threats to Peace | :
Dulles served notice that the
U, S. A. would ask for elimination
of the veto power in all cases
brought to the Security Council
under the “pacific settlements”
chapter of the UN charter as well
as in the admission of new UN
members. That would leave the
veto in operation only in cases in-
volving actual threats to peace or
aggression — instances in which
sanctions or military Operations
might be required.
In the private meeting Gromyko
was understood to have under-
scored Russia's determination to
keep the veto power as is and to
defy small-country assaults on it.

subject to veto, making impossible
any actual alterations at this time |

the continual small-nation war on
the veto, it was learned, have
agreed with an American plan to
cut short the General Assembly
veto debate beginning today and
transfer the entire issue to the
newly-established “Little Assem-
y.
Security Council Asked.
To Join in Study
As a second step, the U. S. A.
and an apparently large number
of supporters will request the Se-
curity Council itself to join the “Lit-
tle Assembly” in a 12-months study
of the veto. °
By bringing the Security Council
into the project, it was believed,
the Assembly could overcome the
fact that Russia plans to boycott
the “Little Assembly”-when it be-
gins functioning early in January
as the year-round subsidiary of
the full General Assembly.
Since the two-part proposal to
be introduced in’ the Assembly’s
Political and Security Committee
| this week by the U. S. A. or one
of its supporters will be like all As-
sembly decisions, a “recommenda-
tion” rather than an order, it will
be possible for the Security Coun-
cil or any one of its members to
refuse to comply.

Italian Government have been warned recently about
all the ships mentioned in your paragraph 2. |
2. On instructions in your telegram No, 1665 they
were informed in a note delivered to Count Zoppi that
certain ships including San Leonardo, Rondine and Yilderan
were strongly suspected and were pressed to take prompt
and effective action to prevent their departure (see my
telegram No.1941). As regards *"Yilderan" P ease also refer
to telegram 2095. The Turkish Embassy haye since |_|.
confirmed that they have approached b sie the Italian
guthorities and say that they expect at action will be
taken to detain this ship.
5. we have also informed the Italian Governnent
that the "St. Moritz" is particularly suspected and have
pressed for her detention.
4, Since, as you are aware, the Italian Government
have been very reluctant to detain ships except on what they
consider legal grounds and the co-operation we can
expect from them in this matter is imited, our practice
has been to reserve our fire and unless specifically
instructed by you to press them for action in particular
places where ships are of considerable size or where our
exverts are reasonably certain that they intend after
sailing to pick up immigrants on the trip they are making.

received no information that this ship was especially

spite of representations reported in Ward's |
despatch No. 441, was not detained in Spezia with |
the result that she was subsequently able to embark
illegal immigrants from North Africa and later again
from Sardinia,

cancelled as Ministry of Foreign Affairs informed us
last July would be done in the case of Italian ships
found engaging in illegal traffic (see Sir Noel

I have a place of business at 500 Fifth Avenue, New York
City, N.Y,
On the 20th day of May, 1947, the United States
iiaritime Commission by telegram, accepted my bid for the
purchase of the SS Col. Frederick ¢c, Johnson (formerly the
oS DeWitt Clinton) and on the 10th day of June, 1947, a
bill of sale executed by the United States Miaritime
Commission, as agent for the United States of America, trans-
ferring title to the gs Col. Frederick C. Johnson was
delivered to me. The United States Maritime Commission
offered said vessel for sale upon invitation for bids
#PD-X-322, Paragraph 8 of said invitation for bids
contained the following statement:
"8. Transfer of age
The Commission will

of award and provided, further, the transferee, in
the determination of the Commission, is not an alien
country, or a national or nationals thereof prohibited

interest thereof. The applicant shall submit such
evidence as the Commission Shall deem necessary in
connection with such application for transfer."

Following the purchase of this vessel, I discovered
that it was not suitable ‘or trading under the American Flag
because the vessel did not comply with the provisions of the
Fire Statute. In order to meet such compliance, it would be
necessary to expend a huge sum of money and it became apparent
to me that such expenditure would not be Justified since the
vessel could thereafter be used only in coastal trading. I
thereupon decided to transfer the vessel for operation under
the Panama Flag and I caused a corporation known as Brownsam
Company, Inc., to be organized under the laws of the Republic
of Panama. This company has been completely organized and
I am the President and Director of said company. I desire
to transfer the said vessel to Brownsam Company, Inc. in
exchange for all of the capital stock of that company and to
operate the said vessel under Panamanian Registry and Flag,
I have, accordingly, submitted an application for approval >
for such transfer to the United States Maritime Commission,
which application is now pending before that government agency.
It was my intention, upon learning that said vessel's
usefulness was very limited and that it would require the ex-
penditure of huge sums of money to place the vessel in
serviceable and sea worthy condition, to negotiate for the
sale of said vessel, I commenced negotiations for the sale
of the said vessel to the Dutch Government through Mr. Hans
Kahn, a Dutch national, Mr. Kahn presented my offer for the

sale of the said vessel to the Director-General of Shipping,
Netherlands Ministry of Traffic, and said offer was turned
down by letter of the said Director-General to Mr. Kahn
dated October 13, 1947. Thereafter, Dr. I. Kahn, father
of the said Mr. Hans Kahn, started to negotiate with me
directly for the purpose of making an arrangement under which
the vessel would be operated in Burope. I cabled Mr. Hans
Kahn offering to him and his father, Dr. I. Kahn, an equal
participation in a partnership for the operation of said
vessel, The affidavit of Mr. Hans Kahn reflecting his
participation in the negotiations involving said vessel is
annexed hereto and fully sets forth the facts relating to
the contemplated use of said vessel.
I have been negotiating with Dr. I. Kahn and Mr.
Hans Kahn for the last four weeks and have reached an agree-
nent with them under which they will own an equal interest
with me in a company which will charter the SS Col. Frederick
C. Johnson from Brownsam Company, Inc., and will operate the
same for our mutual benefit. I understand that the capital
which the Messrs. Kahn will contribute to the operating
company will be approximately 267,000 free Dutch guilders
which, of course, is subject to the approval of the Government
of the Kingdom of Netherlands.
Dr. Kahn has advised me that Mr. Van Riet of the
Rotterdam Lloyd Line has requested him to permit it to act
as agent for any vessels in which he may be interested, and
that upon the consummation-ef. this transaction, the Rotterdam
uioyd Line will be designated as agent for the operation of
this vessel, It is contemplated that Mr. Hans Kahn will be

completion of this transaction.
I should like to indicate that Dr. I. Kahn is a
director of the N.V. Hobimy, and of the Verenigde Theaters
in Holland, two very substantial business enterprises. He is
very well known to Mr. J.F. Van Hengel, who is a representative
of the Netherlands Ministry of Traffic, and his credentials
are on file with the Dutch Embassy in Washington, D.C. His
integrity and general reputation are of the highest character,
Mr. Hans Kahn has had considerable experience in shipping
matters.

It is intended that, upon the completion of this
transaction, this vessel will be taken to Holland where it
will be refitted and repaired and then put in service for
the carriage of passengers and cargo between Rotterdam,
European Atlantic ports and the Mediterranean Sea. It has
been suggested that the contemplated operations may involve
the transportation of passengers and/or cargo which may be
contrary to interests of certain foreign sovernments. Such
insinuation is false and baseless and is contrary to the
interests of Dr. Kahn, Mr. Hans Kahn and myself. As an
American citizen, I have every desire and I hereby furnish
personal assurance that the operations of this vessel will
be conducted in the most correct and legal manner, and will
not be contrary to the interest of any foreign government.
The expenditures which I have already made in this
country in connection with the contemplated use of this vessel
will approximate $100,000.00 and the expenditures which will.
be made for the repairing of the vessel in Holland will also
amount to a considerable figure. I have entered into this
venture with individuals of unquestioned reputation and
reliability and have made far-reaching plans for the operation
of this vessel. These facts bear eloquent testimony to the
undeniable point that the vessel will clearly be operated
in a legitimate trade.

IT am the son of Dr. I. Kahn who is furnishing an affidavit
in connection with the S.S. Col. Frederick GC, Johnson.
I am visiting the United States at the present time in
connection with negotiations for the use of the 85 Col.
Frederick C. Johnson as a passenger and cargo vessel in the
European~Atlantic and Mediterranean trade. Mr. Samuel
Derecktor requested me to communicate with my Government
for the purpose of ascertaining whether my Government was
interested in purchasing the SS Col. Frederick C. Johnson.
I presented Mr. Derecktor's offer to the Director-General of
Shipping, Netherlands Ministry of Traffic and on October 13,
1947, I received a letter from the Director-General advising
me that the Dutch Government was not interested in the purchase
of said vessels My father, Dr. I. Kahn, then commenced
negotiations with Mr. Derecktor for the purpose of concluding
an arrangement under which this vessel would be used in
EBEuropean-Atlantic and Mediterranean operations, Mr. Derecktor
cabled to me offering to create a partnership with me and
my father upon certain terms, the investmént on our part to
be approximately 267,000 free Dutch guilders, which
investment was, of course, to be subject to the approval of
the Royal Dutch Government. I attach a copy of Mr. Derecktor's
cable to me and mark it "Exhibit 1," and a copy of my cabled
reply marked "Exhibit 2". Upon the receipt of this cable,
I went to the acting Director-General of Shipping, Netherlands
Ministry of Traffic in Holland, Upon exhibiting this cable to
him, he stated that he would make funds available for me to

come to the United States for the purpose of negotiating
the transaction with Mr. Derecktor. I immediately cabled Mr.
Derecktor that his offer was accepted and that I would arrive
in the United States on October 28th to negotiate further
with him. I arrived on that date and my father and I have
been negotiating with Mr. Derecktor since that date.
IT examined the affidavit of Mr. Samuel Derecktor
sworn to the 26th day of November, 1947, and confirm and
adopt all of the statements contained in said affidavit
which are ascribed to me and my father involving the
SS Col. Frederick C. Johnson. I join in the assurance given
by Mr. Derecktor as to the intended use of this vessel. It
is respectfully requested that the application of Mr,
Derecktor now pending before the United States Maritime
Commission for approval to transfer the said SS Col. Frederick
C,. Johnson to Panama Registry and Flag, be approved.
